Plain English
Your account is yours alone. Don't lie on it, and you're responsible for whatever happens inside it.
- You must be 18 or older to open an account.
- Provide accurate information, and make sure your phone number is correct.
- You're responsible for everything that happens inside your account.
- Don't share your account or sell it to anyone else.
For customers — when you order
Plain English
You pay before the order is prepared. If we issue a refund, it doesn't exceed the order value itself.
- You pay before the order is prepared. Funds are held by the licensed payment providers (M-Pesa / Tigo Pesa / Airtel Money).
- Cancelling after the cook has started preparing may result in partial refund only — full cancellation is easier before they begin.
- For bad orders (spoiled food, wrong dish, didn't arrive), we'll refund within 24 hours when you submit a photo through chat.
- When we issue a refund, the amount never exceeds the order value itself.
- All communication happens inside the app — we never share your phone number with cooks.
For cooks — when you cook
Plain English
You decide your menu, prices, and hours. We handle delivery and payment; you keep quality high.
- You decide your menu, prices, and operating hours.
- The cook is responsible for the quality, hygiene, and safety of food leaving their kitchen — Mpishi (the platform) is not responsible for that.
- Cooks pay a 15% platform fee per order — this covers delivery, payment processing, and platform usage.
- Weekly payouts arrive on Mondays to the M-Pesa number you registered with.
- We may suspend or close the account of a cook who repeatedly receives low ratings, neglects food safety, or stays inactive for long periods without notice.
Payments, fees, and refunds
An order has four parts: food price, delivery fee, 18% VAT (where applicable), and optional tips. Tips go 100% to the cook.
Refunds, when issued, return to the original payment instrument within 72 hours. For M-Pesa this is usually instant; card refunds may take up to 5 business days.
Things you can't do
Plain English
A few ground rules to keep the platform good for everyone.
- Use the platform for illegal activity — contraband, drugs, smuggling.
- Share or sell your account to someone else.
- Attack the system — DDoS, mass scraping, attempting to break app security.
- Post hateful, violent, or harassing content, or content that violates someone else's rights.
- Ignore or misrepresent food safety information (allergens, ingredients).
Liability and responsibility
Mpishi operates as a connecting platform between customers and home cooks. We do everything reasonable to vet cooks (KYC, kitchen inspections, health certificates) — but the individual cook remains responsible for their food.
Our maximum liability for any claim relating to an order is the value of that order. We disclaim liability for emotional, business, or remote losses.
Account suspension
We may suspend or close your account temporarily or permanently if we believe you're violating these terms. Before closing a cook account, we send a warning and a chance to respond, except for serious safety violations.
You can close your account at any time through app settings, or by emailing hello@mpishi.co.tz.
Changes to these terms
We may update these terms as we build new things. Material changes will be shown in the app and sent by email before they take effect.
If you disagree with the changes, you have the right to close your account before the effective date.
Governing law
These terms are governed by the laws of the United Republic of Tanzania. Disputes will first be resolved through discussion, and if unresolved, through the competent courts in Dar es Salaam.
If any provision of these terms is found unenforceable, the remaining provisions continue to apply.
